NeoMaster Posted April 10, 2005 Share Posted April 10, 2005 Jeremy Jaynes is apparently regretting the use of false domains to spam millions of computers, but he may be a pinch late, as the jury charged with the duty of evaluating his case has recommended a nine year jail sentence. When he was convicted in November, Jaynes was considered one of the world's top 10 spammers. His sentence has been put on hold because the law on spamming is new, and the court will give the defense a chance to appeal the ruling. According to Jaynes' attorney, nine years is too much. Getting past the feelings of burning revenge that every computer user gets when faced with a spam king, we believe that it would perhaps be best to set a good few hard-line examples for the rest of the spamming world. The toughest and most damaging names in the world of 'online marketing' are well known individuals who hide behind smug expressions and freedom of speech laws to continue perpetrating their scams. Spam itself is possibly one of the dumbest, most absurd phenomena on the internet, where seven out of ten spam messages don't even try to sell anything or perpetrate any scam anymore, but simply serve as trojan and javascript probe carriers, turning from mild annoyances to malignant threats to a computer user's system. There should not be so much red tape around it, and we applaud the court ruling for providing such a strong reaction to one of the spam world's most prominent distributors. However, I think the problem isn't with his sentence, but with that of violent criminals. As for the "he's making money off of idiots" point of view.. That's only so true. I worked as an administrator at an ISP for several years, and I can say that he's hurting a lot of other people in the process. It's easy enough for you or me to just empty our spam inbox once in a while, but for my ISP, and for the unwilling servers between him and my ISP, he's putting a big load on their machines, and often their staff, that nobody but him wants anything to do with. He's also putting perfectly innocent "idiots" at risk. What if your grandparents had a computer, and didn't know any better than to open one of his emails? They could end up with all sorts of viruses, spyware, etc. They could end up with trojans that harvest personal information that could be used for identity theft. Not every "idiot" is deserving of that kind of punishment. Other companies are forced by spammers like him to invest in often expensive commercial spam-blocking software. Especially in situations where individual spam-blockers are inefficient, such as tech-support email addresses that are handled by a work-logging program and are pulled by a number of staff. But I still stand by my opinion that 9 years is crazy. do you have any idea how much it costs to house an inmate? in california the yearly cost for 1 inmate is 30,930 dollars. if he serves the whole 9 years (unlikely) it will cost tax payers about 278,370 dollars. now I don't know what state he or if he was prosecuted on the state or fed level. so those numbers are only estimates based on teh california state prison system.
